Please bring all information that pertains to your case when coming to court. This may include proof of insurance, your valid driver’s license, proof of driver’s license address change, proof of class completion, or other information.

For all dockets, except the Attorney Plea Docket, you must check in at the court clerk’s office prior to entering the courtroom. You will be seen in the order you have checked in.

At arraignment, you will appear in court and have the opportunity to enter a plea for the violation(s) you are charged with. You may enter one of three plea options:

• Guilty – You admit to having committed the violation(s) you are charged with. The judge will order a fine, jail time, or other sentence. 
• No Contest – You do not contest the city’s charge(s). The Judge will enter a verdict of guilty and order a fine, jail time, or other sentence. 
• Not Guilty – You deny guilt, which means the city must prove you committed the violation(s) as charged. Your case will be set for trial on a future trial docket. 

The Judge does not hear evidence about the case at an arraignment.

For traffic violations with a scheduled fine amount, you may enter a plea of Guilty or No Contest and pay the fine online, through the mail, or in the court clerk’s office prior to your arraignment date.

Below are class and education provider information that may be a requirement for diversion, probation, and/or a court order:

If you would like your attorney to appear in court on your behalf, or if you are an attorney representing someone in Olathe Municipal Court, you must enter your appearance.

Entries of appearance may be submitted in writing to ocpublic@olatheks.org, or by calling the court clerk’s office at 913-971-6393. The attorney’s Kansas Bar Number must be included on the entry.

If you have missed a court appearance date, you may appear before the judge at 9:30 a.m. on Monday of each week during the court’s walk-in docket. At this time, you may request the court to set aside previously ordered bench warrants. 

If you fail to appear on a violation that is considered a moving violation, you are also subject to a suspension of your driver’s license.

Check the status of your Kansas Driver’s License by entering your Driver’s License No. and First and Last name as it appears on your driver’s license.

House Arrest

The Olathe Municipal Court uses GreenFeather Monitoring for electronic monitoring as an alternative to incarceration at the jail. You are allowed to go to work, school, probation meetings, and court hearings as well as attend any counseling or treatment ordered by the court.

The requirements for house arrest are:

• You must have no illegal drugs in your system to start house arrest. You will be required to drop a clean UA at AverHealth before the judge will prepare an order for house arrest.
• The judge will prepare a written order that has an intake date/time for you to start house arrest. Do not go to the GreenFeather Monitoring office without a written order from the judge.  Intake hours at GreenFeather Monitoring are 8:30 a.m. to 5 p.m., Monday through Friday.      
• You must have a stable address where you are living, and you must have a cell phone (no WiFi phones).
• If you take any prescription medications, you must bring your prescription(s) and pill bottle(s) to your intake appointment.  
• You must pay $100 at your intake appointment with GreenFeather Monitoring to start house arrest ($50 for TouchPoint + must bring smartphone). You can pay with cash, money order, or debit/credit card.  If you do not have the funds at intake, you will be denied and must return to court as directed by GreenFeather Monitoring to see the judge. 
• If you are starting house arrest immediately upon release from jail or finishing Community Weekend Intervention Program (CWIP), you must pay $100 to GreenFeather Monitoring prior to going into custody at the jail or CWIP.  Call 913-489-7955 to make payment arrangements.
• If you fail to appear at your house arrest intake appointment, you are ordered to appear in court at 8:30 a.m. on the very next business day or an immediate warrant will issue for your arrest.

Once you start House Arrest:

• Absolutely no alcohol or illegal drug use will be tolerated.  You will be tested by UAs at AverHealth at your own cost ($20 cash per UA which includes confirmation testing). Any diluted UA is an automatic positive UA.
• You must continue to pay on your house arrest bill. Failure to pay for house arrest will result in your return to court, and you may end up serving your sentence in jail rather than on house arrest. Costs for the various types of monitoring:
  
  • House arrest only (GPS) or alcohol monitoring with remote breath unit only (RBU): $9/day
  • SCRAM Continuous Alcohol Monitoring Bracelet: $10/day
  • House arrest (GPS) plus alcohol monitoring with RBU: $14/day.  
  • House arrest (GPS) plus SCRAM Continuous Alcohol Monitoring Bracelet: $14/day
  • TouchPoint (SCRAM app): $4/day
• You must maintain legitimate employment that can be verified by GreenFeather Monitoring with your employer. You may not change jobs without prior approval from Greenfeather Monitoring.
• Unless the House Arrest is a condition of probation, you must appear in court for a house arrest review, where the judge will review your performance on house arrest and verify that you paid your house arrest bill in full. The judge will need written documentation that you completed any counseling, classes, or treatment ordered by the court, or that you are currently enrolled and attending the required classes/sessions.

You have the right to have your conviction or arrest removed from your criminal record after a certain number of years, as required by K.S.A. 12-4516. Please file a completed Petition for Expungement form and required filing fee to the Olathe Municipal court.

All eligible cases and related cases you wish the court to consider for expungement MUST be listed on the Petition for Expungement. If you are unsure of any additional related cases/charges, please complete an Open Records Request for a Record Request Case List. Incomplete Petitions for Expungement may be returned to the requestor for additional information.

The filing fee for a single case is $200. If multiple motions for expungement are filed on the same date, for the same defendant in difference cases, the filing fee will be $200 for the first case and $100 per case for each additional motion filed.

Your case(s) will not be scheduled for an expungement hearing until the petition has been filed and the filing fee paid. You MUST bring the completed petition and filing fee in person to the Olathe Municipal Court (1200 S. Harrison St.) to be filed.

You have the right to be represented by an attorney in the Olathe Municipal Court. If you are charged with an offense that may result in jail time, you must decide whether to proceed with or without an attorney. If you meet required financial guidelines and the offense you are charged with includes jail time as a penalty, you may be eligible for a court appointed attorney.

Persons visiting the Olathe Municipal Court will be screened when entering the court building to ensure no prohibited items (see list below) are brought into the Municipal Court. All visitors, unless exempted by Administrative Order No. 2021-1, will be required to pass through a walk-through metal detector. All briefcases, handbags, backpacks and personal items will be screened using an X-ray machine.

Screening procedures at the main entrance to the court building will be performed during normal court business hours of 8 a.m. to 4 p.m., Monday through Friday.
