Permits are required for most open burning. A site inspection is required before a permit can be issued.
Permit Fees
Commercial Open Burning Permits are $100 a day.
Residential Open Burning Permits are $25 a day.
Conditions
- Permits for commercial and/ or residential open burning are issued for up to three days from 8 a.m. to 5 p.m., unless exempted by the State of Kansas.
- Burning materials that produce heavy smoke such as heavy oils, tires, tarpaper, etc. are not allowed.
- All complaints (smoke, odor emissions, falling ash, etc.) regarding burning will be investigated by the Olathe Fire Department (OFD). The OFD may order the burning be extinguished, if necessary.
- One or more portable fire extinguisher(s) or other approved fire extinguishing equipment such as dirt, sand, garden hose, etc. shall be available for use.
- All open fires shall be attended until the fire is put out.
- Environmental conditions can impact your plans to burn:
- Before burning, check SkyCast for air quality and Ozone Alert information.
- No burning will be allowed if the ozone forecast for that particular day(s) is yellow, orange, or red.
- This applies even if the permit has been issued.
Commercial Burning Permit Process
Conditions: The location of open burning shall be no less than 1000 feet from any structure or public roadway.
Permit Process:
- Contact Kansas Department of Health and Environment for your Construction/Approval Permit. This permit for your equipment is a two-week to three-week process.
- Complete and return the Burn Permit Application to the Olathe Fire Department. Include a copy of the KDHE State Construction Permit with your permit application.
- After review of your documents, you will be contacted to schedule an inspection of the burn site, once the inspector approves your site you can call to to arrange fee payment and pick up your permit if needed.

Residential Burning Permit Process
- Complete and return the Burn Permit Application to the Olathe Fire Department.
- After review of your documents, you will be contacted to schedule an inspection of burn site, once the fire inspector approves your site, you can call to arrange fee payment and pick up of your permit if needed.
- Permit fees are $25 per day . Checks are payable to the City of Olathe.

Bon Fires
- Complete and return the Burn Permit Application to the Olathe Fire Department.
- After review of documents, you will be contacted to schedule an inspection of the burn site, once the fire inspector approves your site, you can call to make arrangements to pick up your permit if needed.
