The City of Olathe Prosecutor’s Office offers diversion for misdemeanor violations of the Olathe Municipal Code, student traffic infractions, insurance violations and other Municipal Code violations.
To ask about the possibility of diversion the defendant must appear on his/her court date and speak with a prosecutor in court. Normally, to be eligible for diversion, a defendant must be a first-time offender for the violation they are charged with and have a good criminal and/or driving record.
Diversion is offered to qualified offenders and is solely at the discretion of the Prosecutor’s Office. If eligible, the defendant will enter into a diversion contract with the Prosecutor’s Office. If the defendant complies with all conditions of the diversion contract the City Prosecutor’s Office will dismiss the charge or charges at the end of the diversion term.
The Mental Health Diversion program may be available to those struggling with Serious Mental Illness (SMI). The City of Olathe Prosecutor's Office has partnered with Johnson County Mental Health Center to direct defendants into needed care and treatment to improve their quality of life.
